How is maternity leave pay calculated?

  1. No pay before 12 months of service
  2. Length of leave = 50 days at full pay, at least 35 after the birth
  3. Daily wage = basic wage ÷ 30
  4. Leave pay = 50 × daily wage

What does maternity leave pay on a 6,000 basic wage?

An employee on a basic wage of 6,000 QAR, with two years of service, starts her maternity leave.

  1. The condition of a full year of service is met, so the leave is paid
  2. Daily wage: 6,000 ÷ 30 = 200 QAR
  3. Maternity leave pay: 50 × 200 = 10,000 QAR

The employee is owed 10,000 QAR for her maternity leave on the basic wage, with at least 35 days of it after the birth, so no more than 15 days can come before it.

Who is entitled to maternity leave, and on which wage?

Under Article 96 of Qatar Labour Law No. 14 of 2004, a worker who has completed a full year in her employer's service is entitled to maternity leave at full pay for fifty days, covering the time before and after the birth, provided that at least thirty-five days fall after it. The leave is granted on a medical certificate from a licensed doctor giving the likely date of birth.

The article does not say which wage the leave is paid on. Article 72 puts annual leave, sick leave and the end-of-service gratuity on the basic wage and does not mention maternity leave, and Article 1 defines the wage as the basic wage plus all allowances. The calculator uses the basic wage divided by 30, the lower reading, and keeps the question under review until a ruling or the ministry's practice settles it.

If less than thirty days of the leave remain after the birth, the worker may be given the rest from her annual leave, and otherwise it counts as unpaid leave. If her health keeps her from returning after the birth, she is on unpaid leave, with the absence capped at sixty days in one spell or several, on a medical certificate. Maternity leave takes nothing from her other leave, and after it she gets a nursing hour a day for a year under Article 97.

  • Condition: a full year in the employer's service (Article 96)
  • Length of the leave: 50 days at full pay, at least 35 of them after the birth
  • Daily wage = monthly basic wage ÷ 30, and the wage basis is under review
  • After it: up to 60 days unpaid if her health keeps her from returning

Questions about maternity leave in Qatar

How long is maternity leave under Qatar labour law?

50 days at full pay under Article 96, covering the time before and after the birth, with at least 35 days after it.

Am I entitled to paid maternity leave before completing a year at work?

Article 96 gives paid maternity leave to a worker who has completed a full year in her employer's service, and says nothing about one who has not. So the calculator shows no pay in that case, though your contract may give more.

Do allowances count towards maternity leave pay?

The text does not settle it. Article 96 says full pay without naming the wage, and Article 72 puts only annual and sick leave on the basic wage. The calculator uses the basic wage, and if the full wage is meant, a worker with allowances is owed more.

What if fewer than 30 days remain after the birth?

You may be given the rest from your annual leave, and otherwise it counts as unpaid leave, under Article 96. The calculator does not cover this, because it depends on the actual date of birth.

Can my contract be ended because of marriage or maternity leave?

No. Article 98 bars the employer from ending a worker's contract because she married or took maternity leave, and from giving her notice during the leave or notice that runs out during it.

Do I get nursing time when I return?

Yes, a nursing hour a day for a year starting after the maternity leave ends, under Article 97. It counts as working time and nothing is deducted from your pay for it.
