How is maternity leave pay calculated?

  1. Length of leave = 60 days: 45 at full pay, then 15 at half pay
  2. Daily wage = (basic + allowances) ÷ 30
  3. Leave pay = 45 × daily wage + 15 × daily wage × 50%

What does maternity leave pay on 10,000?

An employee on a monthly wage of 10,000 AED (8,000 basic + 2,000 allowances) starts her maternity leave.

  1. Daily wage: 10,000 ÷ 30 = 333.33 AED
  2. The first 45 days at full pay: 45 × 333.33 = 15,000 AED
  3. The next fifteen days at half pay: 15 × 333.33 × 50% = 2,500 AED
  4. Total: 15,000 + 2,500 = 17,500 AED

The employee is owed 17,500 AED for her maternity leave, and if an illness from the pregnancy or birth keeps her from returning afterwards, she may take up to 45 more days unpaid.

How long is maternity leave, and when does it start?

Under Article 30 of Federal Decree-Law No. 33 of 2021, a working woman is entitled to sixty days of maternity leave: the first forty-five days at full pay and the fifteen days after them at half pay. The text sets no length of service, and the leave is due for a birth after six months of pregnancy or more, even if the child is stillborn, or born alive and then dies.

The employer must grant the leave when she asks for it, from the last day of the month immediately before the expected month of birth, on a medical certificate. The leave is paid on the wage, not the basic wage, because Article 1 defines the wage as the basic wage plus the cash allowances and benefits in kind she is entitled to. The calculator divides the monthly wage by 30 to get the daily wage, a convention the article does not state.

If, after the leave, an illness of hers or of the child caused by the pregnancy or birth keeps her from returning to work, she may take up to 45 days unpaid, in one spell or several, on a medical certificate, and those days count neither towards gratuity service nor towards pension contributions. If the child is born sick or with a disability and needs constant care, she gets 30 days at full pay after the maternity leave on a medical report, which may be extended by 30 days unpaid. She may not be dismissed or given a warning because of the pregnancy or the leave, and she gets nursing breaks of up to an hour a day for six months from the birth.

  • Length of the leave: 60 days, days 1 to 45 at full pay and days 46 to 60 at half pay
  • No service condition, and she may start from the last day of the month before the expected month of birth
  • Daily wage = monthly wage (basic + allowances) ÷ 30
  • After it: up to 45 days unpaid for an illness from the pregnancy or birth, with a medical certificate
