- notice required
- 30 days on a monthly wage, 15 otherwise, or a longer agreed period
- gross wage
- The basic wage with all allowances and stipends (Article 1)
What are 30 days of notice worth on 600?
A monthly-paid worker on a basic wage of 500 OMR with 100 OMR of allowances has an indefinite contract ended by the employer without any notice.
- Notice required: 30 days, as the worker is paid monthly
- Days not served: 30 − 0 = 30 days
- Gross daily wage: (500 + 100) ÷ 30 = 20 OMR
- Compensation: 30 × 20 = 600 OMR
The worker is owed 600 OMR in place of notice, on top of the end-of-service gratuity and any leave balance. Had the worker been paid other than monthly, the notice would have been 15 days and the compensation 300 OMR.
When is it owed, and on which wage?
Article 38 lets either party end a contract of indefinite period for a legitimate reason by written notice 30 days before termination for a worker on a monthly wage, and 15 days for others, unless the contract agrees a longer period.
If the contract is ended without the notice, the party ending it pays the other compensation equal to the notice period or what is left of it, on the final gross wage the worker was receiving. The gross wage is the basic wage with all allowances and stipends (Article 1).
Notice the employer gives a worker who is on leave only starts the day after the leave ends, and during the notice the worker may be absent 10 paid hours a week to look for work (Article 39). This calculator does not cover fixed-term contracts.
- Notice: 30 days on a monthly wage, 15 days otherwise (Article 38)
- Compensation = the notice or what is left of it × gross daily wage
- Daily wage = (basic + allowances) ÷ 30
- Notice does not run during leave, and the worker gets 10 hours a week to look for work (Article 39)
