How it's calculated

Under Article 43 of Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations, either party may end the employment contract for a legitimate reason by written notice to the other party, observing the notice period agreed in the contract, which can be no shorter than 30 days and no longer than 90 days. The same period applies to the employer and the worker alike.

The contract stays in force throughout the notice period: the worker is entitled to the full wage for it based on the last wage received, and must keep working during it if the employer so requests (Article 43(2)). The period runs in calendar days, so weekly rest days and public holidays count towards it.

If either party fails to observe the period, Article 43(3) makes it pay the other a compensation called the notice period allowance, equal to the worker's wage for the full notice period or the remaining part of it, even if the other party suffered no loss. This calculator divides the full monthly wage by 30 to get the daily wage, then multiplies it by the unserved days.

Worked example

An employee's full monthly wage is 10,000 AED (7,000 basic + 3,000 allowances) and the contract sets a 30-day notice period. The employer terminates the contract immediately, without any notice.

  1. Notice required by the contract: 30 days; served: 0; unserved: 30 days
  2. Daily wage: 10,000 ÷ 30 = 333.33 AED
  3. Notice pay: 30 × 333.33 = 10,000 AED (a full month's wage)

The employee is owed 10,000 AED as notice period allowance under Article 43(3), on top of the gratuity and any unused leave. Had 10 days of the notice been worked, the allowance would drop to 20 days' wage, 6,666.67 AED.

FAQ

How long is the notice period under the UAE Labour Law?

Between 30 and 90 days, as agreed in the employment contract under Article 43, and never less than 30 days; you will find it in your contract registered with the Ministry of Human Resources and Emiratisation. It applies to fixed-term contracts too, since the 2021 law allows them to be ended before expiry by notice for a legitimate reason.

Is notice pay based on the basic salary or the full wage?

On the full wage. Article 43(3) sets the compensation at the worker's wage for the notice period or its remainder, and the wage under the law includes the basic salary and allowances, unlike the end-of-service gratuity, which is calculated on the basic salary alone.

I resigned without serving the full notice. What do I owe?

You owe the employer a notice period allowance equal to your wage for the unserved days, which is usually deducted from your final settlement. Your gratuity remains payable in full once you have completed one year of service, because the 2021 law does not reduce it for resignation.

Can the employer terminate my contract without notice?

Only in the disciplinary dismissal cases listed in Article 44 (such as forged documents, a gross error causing material loss, or unjustified absence of more than 20 intermittent days or 7 consecutive days in a year), and after a written investigation. Otherwise the worker is owed the full notice period allowance even without proof of any loss.

Does the notice period apply during probation?

No, probation has its own rules in Article 9: the employer may end the contract during probation with at least 14 days' written notice, while the worker must give at least 30 days' notice to move to another employer in the UAE, or 14 days to leave the country.

Can I take time off to look for a job during the notice period?

Yes. When the employer gives the notice, Article 43 entitles you to one unpaid day a week during the notice period to look for another job, provided you notify the employer at least three days before the absence.
